10.30  OPEN BURNING

Subd. 1. No open burning except by permit.

A.  It is unlawful for any person to cause, allow or permit open burning, except after obtaining a permit for the open burning issued pursuant to M.S. Chapter 88, as it may be amended from time to time, and the open burning is conducted in accordance with the requirements of M.S. Chapter 88 and the conditions of the permit.

B.  Permits shall not be issued for open burning of leaves as a method of disposing of ordinary accumulation of leaves.

Subd. 2.  Fires for food preparation.  Fires set for food preparation are allowed without obtaining a permit, provided only unpainted and untreated wood, coal or charcoal is burned and provided further the fire is contained within a grill, firebox made of metal, fireplace or other fire burning equipment designed for such purpose and further complies with all other state regulations pertaining to open burning.

Subd. 3.  Fires for food preparation are allowed in Sutton Park by permit.  Recreational fires shall be permitted in Sutton Park, provided the fire is conducted entirety within the fire ring within the park constructed for that purpose, and provided further a permit for the fire has been obtained from the Park and Recreation Department.
